Trace Bandel, Attorney at Morgan, Akins & Jackson, PLLC, working with Chad Jackson, took lead and succeeded on a recent Rule 56 Motion for Summary Judgment, based on a lack of legal duty owed by the firm’s client to the Plaintiff. Plaintiff initially sued a homeowner based on a legal theory that the homeowner owed a duty to protect a Plaintiff from falling off a ladder on the homeowner’s property, but failed provide facts which showed a special relationship between the Plaintiff and the homeowner. At the hearing, the Plaintiff argued that providing a ladder to the Plaintiff was akin to providing someone with a “gun” and walking away, but the Court ultimately agreed with Trace’s argument that the sole act of making a tool available does not impose an affirmative duty to supervise an invitee on the homeowner’s property. The Court summarily dismissed all claims against the firm’s client.
