Nate Bohlander, a partner in the Philadelphia office, recently secured dismissal of Plaintiffs’ complaint, via preliminary objections, on behalf of an adventure park client. The case was filed in the Montgomery County Court of Common Pleas. Attorney Bohlander filed preliminary objections to the Complaint seeking the dismissal of portions thereof, as well as a finding that Plaintiffs had failed to established a basis for the advancement of strict product liability claims against his client. Therein, Attorney Bohlander argued that Plaintiffs failed to plead their allegations with requisite specificity, in violation of Pennsylvania Rules 1019 and 1028. The Court granted the preliminary objections, struck the entirety of the complaint for insufficient specificity, and set forth that Plaintiffs must file an amended pleading in accordance therewith.
