Nate Bohlander, a Partner in the Philadelphia office of Morgan, Akins & Jackson, recently obtained a dismissal on behalf of one of the firm’s airline clients in a discrimination case filed in the U.S. District Court for the District of New Jersey. In the Complaint, Plaintiff set forth twelve counts, including those based both in federal and state law. In response, we filed a Motion to Dismiss advancing, among other arguments, that Plaintiff’s claims were preempted, that Plaintiff did not sufficiently set forth the claim elements, and that Plaintiff failed to comply with applicable procedural rules. The Court granted our Motion in part, and, after Plaintiff failed to cure the defective issues, dismissed the Complaint with prejudice.
