Nicholas Akins, Managing Member, and Richard Bandel, Associate Attorney in our Nashville office, obtained a favorable summary judgment ruling in Davidson County Circuit Court for our client, a large gas station and retail convenience store chain. We moved for judgment in this premises liability case based on disputes concerning the alleged hazard and notice to the Defendant. The Court found Plaintiff would be unable to meet his burden of proof at trial, based largely on testimony elicited in depositions.
