Morgan, Akins & Jackson’s Nashville Office Secures Dismissal on T.R.C.P. Rule 12.02(6) Motion, Improper Service, and Naming an Indispensable Party Improperly

Attorney Noah Rudloff, an Associate in the Nashville office recently secured a successful dismissal in Hamilton County General Sessions Court (Chattanooga, Tennessee), in which the Plaintiffs attempted to bring a cause of action pursuant to European Union Regulation 261/2004. Despite Plaintiffs’ rebuttal that they had additional claims separate and distinct from EU Regulation 261/2004, the Court found in favor of Defendants and dismissed the matter with prejudice based on Tennessee Courts’ lack of jurisdiction over the matter, improper service, and failure to properly name an indispensable party.
